Biden Weighs Executive Orders on Abortion With Future of Roe in Jeopardy

President Joe Biden is considering executive orders to protect abortion access as Democrats have moved to pass laws in recent weeks with the future of Roe v. Wade in jeopardy.

“We have to make sure we pass legislation making [abortion] a law,” Biden said during a Wednesday appearance on Jimmy Kimmel Live! If the Supreme Court overturns Roe this month, abortion will become illegal in 20 states, which the president said will “cause a mini revolution” of state-level legislation by Democrats. “I don’t think the country will stand for it,” Biden added.

“President Biden’s desire to issue an executive order to keep abortion legal in those states directly contradicts the Court’s ruling and the will of the people in those states,” Carol Tobias, president of National Right to Life, told the Washington Free Beacon

    Tenth Amendment is incorporated by reference into the Constitution by the Latin maxim expressio unius est exclusio alterius meaning powers expressed excludes all others not expressed and of like or unlike kind, same reserved to the people or the States.

    So now SCOTUS is going to honor the Tenth Amendment, after 50 years delay, by holding its abortion ruling erroneous. POTUS is considering executive order or directive conditioned on no final Alito opinion. Can he do that? No, because he is Executive Branch only, to see to it that laws enacted by Legislative Branch are faithfully carried out. He can neither legislate like Legislative Branch nor sit in review of Judicial Branch, and, if he does it would be null and void, to be disregarded as such, but in any event the States, or the people, will act pursuant to the Tenth Amendment.
