Attorneys for Hunter Biden, the son of President Joe Biden, repeatedly cited the Second Amendment in a number of court filings related to his alleged illegal ownership of a firearm.
Hunter Biden has been charged with three felonies related to him allegedly improperly claiming on federal forms that he was not addicted to illegal drugs when he purchased a revolver five years ago, even as he was addicted to crack cocaine at the time. Attorneys contended in court documents that individuals âprotected by the Second Amendment can no longer be denied gun ownership due simply to past drug useâ after a Fifth Circuit decision earlier this year.
The document said that asking the first son about his âstatus as a user of a controlled statusâ is now âconstitutionally irrelevant,â additionally contending that the question was âinconsistent with this nationâs historical tradition on firearm regulation.â
