Pro-Gun Organization Files Motion for Permanent Injunction Blocking ATF From Enforcing Illegal Trigger Prohibition Nationwide

On November 3, 2023, the National Association for Gun Rights filed a motion for summary judgment in federal district court. On a previous occasion, the court previously granted a temporary restraining order and a preliminary injunction in NAGR v. Garland. The latter protects NAGR members from being harassed by ATF agents concerning forced reset triggers. NAGR’s lawsuit takes on the ATF’s expansion of the statutory definition of what constitutes a “machinegun.”

“Despite the court ruling, the ATF continues to contact NAGR members, informing them falsely that their triggers are machine guns, threatening them with criminal penalties, and demanding the ‘voluntary surrender’ of their lawfully possessed triggers,” declared Hannah Hill, Executive Director of the National Foundation for Gun Rights (the legal branch of the National Association for Gun Rights.)

The court’s injunction declares that “the ATF’s expanded definition of ‘machinegun’” is “likely unlawful.”

When confronted with its failure to comply with the court’s order, the ATF’s legal counsel called on NAGR to provide a list of its members — an illegal request which NAGR categorically rejected…
