Surprise: SCOTUS Doesn’t Release Ruling for Dobbs Case that Could Overturn Roe v. Wade

Monday, the day the Supreme Court was expected to start releasing opinions for this year, came and went without the Supreme Court releasing an opinion in the Dobbs case that could overturn the current abortion regime, particularly Roe and Casey, the same case in which Justice Alito’s opinion was leaked.

Fox News, reporting on the Supreme Court’s strange decision not to release the opinion, said:

The Supreme Court Monday did not issue a ruling in the case Dobbs v. Jackson Women’s Health Organization, prolonging for at least one more week the wait for its opinion which is expected to overturn the right to an abortion…

    Roberts’ post-leak statement: “To the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed. The work of the Court will not be affected in any way.” Well, Dobbs opinion should have been released Monday, now won’t happen until late June or early July, so that’s about a month, and bad use of word “affected” Mr. Chief Justice when in reality delay has “effected” late release and with only about a month left in current term. Another thing, SCOTUS doesn’t reverse itself, rather holds erroneous its reasoning in its prior ruling on review, leaving it to the States under the 10th amendment, if and when that happens, and decision final. So looking at several law clerks and others signing affidavits about the leak of Alito opinion, but opinion not released, how about them apples?!

    The leaked Alito draft opinion may end up being the law of the land if the Supreme Court does not release this opinion before current term expires. States are already ready to fulfill their duty under the Tenth Amendment, and should not wait further considering irregular federal system signals.
