Supreme Court Grants Biden’s Request To Dismantle Texas Razor Wall That Slowed Flow Of Illegals, Trump-Appointed Judge Was Deciding Factor

Today the Supreme Court ruled in favor of a request from President Joe Biden to disassemble a makeshift barbed wire-razor wall in Texas, which was designed to try and slow the number of illegal immigrants flowing across the southern border.

The Supreme Court ruled in a 5-4 majority.

John Roberts led the majority, alongside justices Sonia Sotomayor, Elena Kagan, Ketanji Brown Jackson, and Amy Coney Barrett. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh dissented.

A divided US Supreme Court said the Biden administration can remove parts of a fence along the southern border built by Texas to try to stem illegal immigration.

In an order on Monday, the justices vacated a December ruling by the US Court of Appeals for the Fifth Circuit that said the US Border Patrol could only cut down razor wire fencing along the Rio Grande in an emergency.

The high court provided no explanation for its decision, which is customary in emergency applications. Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh said they would’ve denied the request to toss the lower court injunction while the litigation continues. They also offered no reason for their decision.

The 29-mile fence is part of the escalating fight between the administration and Texas Gov. Greg Abbott (R) over how to manage record high levels of migration along the Southwest border.

Abbott has launched an operation to dispatch state officers to enforce federal immigration laws, which has fueled tension with the administration and resulted in a string of lawsuits.

“Texas’ political stunts, like placing razor wire near the border, simply make it harder and more dangerous for frontline personnel to do their jobs,” said White House Assisant Press Secretary Angelo Frenandez Hernandez in a statement.

Texas Attorney General Ken Paxton said the “fight is not over.” The “destruction of Texas’s border barriers will not help enforce the law or keep American citizens safe,” Paxton said in a statement.

‘Serious Risk’

In the border fencing dispute, the administration told the justices that the limited emergency exception for the Border Patrol posed a “serious risk to human life” because it didn’t give agents enough time to respond to medical emergencies, and that one woman and two children had drowned on Jan. 12.

It is impossible to say what might have happened if Border Patrol had had its former access to the area—including through its surveillance trucks that assisted in monitoring the area…
